Please read these Terms and Conditions very carefully. If you do not understand any part of this document please seek professional advice. You have limited rights to returning goods once an order has been placed.

We hope that our website offers you a clear and convenient way to shop, if however you have any questions, comments, general inquires or would like to place an order over the phone please contact our customer service team who will be happy to assist.

Terms and Conditions of Trading of Be Home Collection.

Be Home Collection operates behomecollection.com from our offices with in England. Accordingly the laws of England and Wales govern claims relating to, including the use of the web site and the materials contained therein. If you choose to access our website from outside England and Wales you do so at your own free will and you hereby agree that in the event of a dispute between behomecollection.com and you the laws of England and Wales will apply at all times.

  • 1.Interpretation

    The definitions and rules of interpretation in this clause apply to this agreement.

    Bespoke: Goods that are made to order to your specification in your choice of Be Home Collection fabrics.

    Goods / items of furniture: words to describe individually or collectively - sofa, armchair, Chaise Longue, settle, pouf, chair, coffee table, side table, console table, foot stool, cushion, mirror and or light.

    UK Mainland: this is the island of Great Britain and excludes Northern Ireland and any British islands that are geographically separated from the island of Great Britain.

  • 2. Contract

    2.1 These Terms and Conditions of Trading ('agreement') apply to all consumer contracts between Be Home Collection Limited and our subcontractors ('us/we/our') and the Customer ('you/your') in relation to all goods and services.

    2.2 Any order placed with us will not be accepted until we have sent a sales order confirmation to you via e-mail.

    2.3 Any typographical, clerical or other error or omission in any sales literature, quotation, pricelist, acceptance of offer, invoice or other document issued by us will be subject to correction without liability on our part. This includes inaccuracies or errors that appear on this website.

    2.4 We exclude all warranties, expressed or implied as to the accuracy of the information contained in any of the materials on the website. We cannot accept any liability for any particular material on the website or as a result of any use or reliance placed upon information contained on the website.

  • 3. Return policy – Online [Non bespoke items]

    3.1 If you are not entirely satisfied with your purchase from Be Home Collection, please notify us by in writing or by email within 7 days of receiving your order, stating your intention to return the product(s). Item(s) of furniture are to be returned to us unused and in their original packaging. You will be entitled to a full refund within 30 days or a replacement (with a completed returns form). It is your responsibility to pay for the cost of returning the ordered item(s) of furniture. If you fail to return the item(s) of furniture, or send them at Be Home Collection Limited expense, we will charge you the cost of the return even if we have already refunded your money. We do pay for the return of item(s) of furniture if the goods are faulty.

    3.2 Damaged item(s) of furniture should be notified to our customer service team immediately and left no longer than 5 days or else a refund will not be considered. It is your responsibility to check carefully and that by signing you have accepted the items are in a good condition as no refund will be given after the 5 days. Should your item be damaged while being unpacked by the delivery company, the delivery company will take the item away, along with a returns form completed by the customer and the delivery company. [We ask that damaged item(s) of furniture are packed and returned in their original packaging and the returned item(s) are unused. We reserve the right to make reasonable deductions from the amount refunded to you if there is any signs of wear and/or damage to the goods]

    In respect of damage(s) to good(s) reported to Be Home Collection after 24 hours of receipt. We will require proof that the good(s) were damaged before receipt by you.

    3.3 Care instructions will be dispatched with most items. Please take the time to read this information as unfortunately we can't accept items for refund or exchange if they have been damaged in contravention of any care instructions.

    3.4 Replacements for exchange of damaged goods will not be dispatched until the original item has been received and a returns form returned filled in.

    3.5 We are unable to compensate for damaged item(s) of furniture in relation to distress, inconvenience or disappointment to your self.

  • 4. Returns policy - Online [Bespoke items and one off pieces]

    4.1 Once an order as been placed and a sales order has been emailed to you for a bespoke item of furniture you cannot cancel this order, before or after delivery. These items of furniture have been made to your specification and are bespoke to you. Unfortunately, we are not able to accept returns nor will we be able to provide you with a refund, unless the items have been accidentally damaged in transit or are defective. This does not affect your statutory rights.

    4.2 Be Home Collection source one off items, which are made individually and shipped accordingly. These items are unique and no two are exactly alike there may therefore be variations in colour or finish between these items due to the manufacturing process and they cannot be returned, unless they arrive damaged, in which case a refund will be given.

  • 5. Measurement

    5.1 We will not take responsibility if an item does not pass freely into your choice of room. Be Home Collection advise that before you place an order you check your measurements. The delivery charge does not include for the removal of doors, windows or other fixtures.

    5.2 We advise that replacement loose covers are ordered at the time you order your item of furniture. We cannot guarantee a snug fit if a loose cover is ordered after your item of furniture has been delivered.

  • 6. Delivery

    6.1 Items of furniture, bespoke and non bespoke, from Be Home Collection can be delivered to anywhere within UK Mainland. Your order will be dispatched and delivered within 6-8 weeks of your order being received; this is subject to your fabric choice being in stock. If your fabric is not in stock we will notify you and confirm a new lead-time. If we are able to improve on the delivery lead-time we will notify you in writing. We will notify you of a delivery date and keep you updated by email, and will endeavor to arrange with you a convenient delivery date and time (am or pm). Updates will include notification of when your item(s) of furniture are ready for shipping and a proposed delivery date. An additional charge will be incurred if delivery is aborted for whatever reason by you once a delivery date and time is confirmed. A correct delivery address and contact telephone number must be submitted at time of order.

    6.2 For deliveries outside UK Mainland please contact the customer service team. Separate Terms and Conditions in relation to deliveries will apply and are available on request.

    6.3 Standard delivery is between Monday to Friday 08.00-18.00hrs, where possible a convenient time slot to you will be allocated. Deliveries outside this time will be subject to additional charges and subject to confirmation from Be Home Collection.

    6.4 Parking restrictions, meters and any other restrictions that may occur during delivery need to be confirmed with Be Home Collection Limited prior to the time of delivery. Additional costs may be incurred if we are not notified and may delay the delivery of your item(s).

    6.5 Our professional carriers will place the item(s) of furniture, with white gloves, to the room of your choice. Our delivery team will then unpack the goods for inspection and once approved and signed off by you and the delivery company will remove all packing materials. [It is important that before you sign off on an item of furniture that you check for damage]

    6.6 You are responsible for providing a safe and reasonable means of access from the public highway to the place of delivery. If access is proved unsafe, then the carrier will not deliver the item(s) until a safe access is provided. If we are unable to deliver to a safe or reasonable means of access to the place of delivery, Be Home Collection Limited will be entitled to cancel your order and delivery and not refund the customer. If your item(s) of furniture are to be placed above a 1st floor please notify our customer service team before you're due delivery date.

    6.7 Be Home Collection will not be liable for delays or events outside our reasonable control that increase the agreed time allocation for delivery.

    6.8 Be Home Collection is unable to take responsibility for any damage to goods/or property as a result of deliveries going into your property. If there is any damage to your place of delivery please notify our customer service team immediately as we cannot take responsibility but we will take up any matters with our delivery company on your behalf.

    6.10 Any changes made to the initial order will have an impact on your delivery date and may incur an additional charge. Check your order confirmation carefully as we are not able to make changes.

    6.11 Be Home Collection will not be liable for any direct or indirect loss of profits or other financial loss or damage suffered by you through any reasonable delay or delays due to unforeseen circumstances outside of the reasonable control of Be Home Collection or any delays due to any reasonable rescheduling of delivery.

    6.12 Unfortunately we are unable to provide a service to dispose of any unwanted furniture, nor are we able to dismantle or assemble furniture of any kind.

  • 7. Pricing

    7.1 Prices include delivery cost. Delivery charges are excluded in some cases.

  • 8. Payment

    8.1 The total amount payable for an item of furniture is required in cleared funds on all orders placed prior to the order being accepted by us. Once we are satisfied payment has been received, we will then accept your order by sending via e-mail an sales order confirmation.

    8.2 We are entitled to refuse any order placed by you and no contract shall be concluded until an sales order confirmation has been issued by us.

    8.3 A delivery date will be confirmed once we have received the balance of the monies due in cleared funds.

  • 9. Reproduction

    9.1 The colour and texture of the fabric on your item(s) of furniture may differ slightly from the sample we have sent you. We do endeavor to match the samples as accurately as possible, but variations in colour and/or texture may occur. Goods may not be exactly the same colour as shown on the web site.

    9.2 Multiple furniture orders will be made from the same batch of fabric, however we cannot guarantee that fabrics will match subsequent orders.

    9.3 Some items are made from quality natural wood. Some woods will mellow with age. Exposure to sunlight and different environmental conditions will alter the appearance of the item of furniture you have purchased. Many of the items at Be Home Collection are not mass-produced therefore sizes, colour variations and finish may vary.

    9.4 Leather is a natural material and will show natural markings and variations over time. Leather will mellow over time and alter when exposed to heat and sunlight.

    9.5 The linen on your sofa or armchair is 100% pure Belgian linen, with the exception of the Simply fabric range which is 91% pure Belgian linen and 9% PA. These are manufactured using natural products therefore impurities are a natural quality of the fabric and not a fault. Fabric batches may vary and there can be slight variations in colour between batches. Please read the care instructions we include with all our furniture. We cannot accept any responsibility for fading or discolouration of fabric, due to exposure to direct or indirect sunlight. Exposure or contact with chemical sprays or cleaning products can also cause the fading or discolouration of fabric. We cannot accept responsibility for the incorrect use of cleaning products.

  • 10. Descriptions and product information

    10.1 The pieces of furniture and accessories we show on the website are shown as accurately as possible. However, the colour of the products may vary due to the nature of your computer, software or printer. Variations may occur as a result and the goods you receive may not be exactly the same as the colour shown on the website. We therefore advise that you request a free fabric sample by using the sample link on the website.

    10.2 We keep our website up to date and every effort is made to ensure the information, pricing and details are as accurate as possible. However information may change from time to time and it is possible that errors may occur. Any errors will be rectified as quickly as possible and we cannot be responsible for any loss incurred as a result.

    10.3 The majority of our furniture is bespoke and made especially for you, items are handmade or hand-finished using natural materials, therefore the measurements on sofa, armchairs, poufs and chaise longue's are approximate. Please allow slight discrepancy of 1-2cm larger or smaller then specified. If you have any concerns regarding space and measurements please contact us on email hello@behomecollection.com.

  • 11. Faults

    11.1 In the unlikely event that you experience a fault with your bespoke or non bespoke item of furniture please contact hello@behomecollection.com and we will help to rectify any problems.

    11.2 The provisions of this clause apply in addition to your statutory consumer rights in relation to faulty or misdescribed goods. These rights are not affected by this clause.

    11.3 Be Home Collection is not able to offer refunds or be held responsible on general wear and tear, neglect or misuse on items of furniture. We do not cover loss or damage (including rusting and corrosion) due to unreasonable exposure to water or weather, loss or damage due to fire, smoke, explosion, lightening, sunlight, infestation by animals or boring insects, or theft, or accidental damage or loss caused by a third party. Nor are we able to offer refunds where you have tried your own repair or had someone else attempt a repair, and this has damaged the goods.

    3. you may not, except with our express written permission, distribute or commercially exploit the content. Nor may you transmit it or store it in any other website or other form of electronic retrieval system.

    12.3 Downloading material through the use of this website is done at your own discretion and risk. You will be solely responsible for any damage to your own computer system or loss of data that results from the download of such materials.

  • 13. Rights of Third Parties

    13.1 For the purpose of the Contracts (Rights of Third Party) Act 1999, this agreement does not and is not intended to give any rights, or any right to enforce any of its provisions, to any person who is not a party to it.

  • 15. Applicable Law

    These Terms and Conditions of Trading are governed by and are to be construed in accordance with the law of England and Wales.
